Certain features or services offered on or through the Etergo Website may require you to open a Etergo user account. You agree to notify Etergo immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Etergo or any other user of or visitor to the Etergo Website due to someone else using your password or account as a result of your failing to keep your account information secure and confidential.You may not use anyone else’s password or account at any time without the express permission and consent of the holder of that account. Etergo cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

We have not approved or checked any third-party sites linked to our website and we are not responsible or liable in any way for their content. Your use of third-party sites will be subject to the terms and conditions of those sites.
6. Interference
You must not damage, interfere with or disrupt access to our website or the content, nor do anything that may impair functionality or interfere with another person's access to the website. You must not use the website in any way that is unlawful or damaging to us or any other person. 7. Liability and compensation of damages
Except where prohibited by law, in no event will Etergo be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Etergo has been advised of the possibility of such damages. If, notwithstanding the other provisions of these terms of use, Etergo is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Etergo website or its content, Etergo’s liability shall in no event exceed the greater of (1) the amount paid out to Etergo under its insurance policy, or (2) EUR 100. Nothing in these terms limits our liability for damage caused (i) with willful intent, fraud, or gross negligence, or (ii) for damage relating to death or personal injury caused by our negligence.
8. Govering law
These terms of use are governed by Dutch law. You irrevocably agree that the competent courts in Amsterdam will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms of use (including non-contractual disputes or claims). Before bringing a formal legal claim, you must first raise the issue with our support or legal team. In most cases we can resolve disputes that way.
